ARTICLE 1 – SCOPE

These General Terms and Conditions of Sale apply, without restriction or reservation, to all rentals of accommodation or unoccupied pitches at Camping Le Barralet, operated by SARL Capelle (“the Service Provider”), to customers acting for non-business purposes (“Customers” or “the Customer”), through its website www.barralet.fr or by telephone, post or email, or at any location where the Service Provider markets the Services.

The main features of the Services are presented on www.barralet.fr or in written form, on paper or electronically, when bookings are made by a method other than distance ordering.

The Customer must read this information before placing an Order. The Customer is solely responsible for selecting and purchasing a Service.

These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions of the Service Provider, including those applicable to other sales channels for the Services.

These General Terms and Conditions of Sale are available at all times on the website and shall, where applicable, take precedence over any other version or contractual document. The version applicable to the Customer is the version in force on the website or communicated by the Service Provider on the date the Customer places the Order.

Unless proven otherwise, the data recorded in the Service Provider’s computer system constitutes evidence of all transactions concluded with the Customer.

Under the conditions laid down by the French Data Protection Act and the European General Data Protection Regulation, the Customer may at any time access and rectify their personal data, and object to its processing where such processing is not essential to fulfil the Order and the stay or deal with any related matters. These rights may be exercised by writing, with proof of identity, to:
Camping Le Barralet
6 chemin du grès
30210 COLLIAS

The Customer acknowledges having read and accepted these General Terms and Conditions of Sale, together with the terms of use of www.barralet.fr, either by ticking the relevant box before proceeding with the online ordering process or, for bookings made offline, by any other appropriate means.

ARTICLE 2 – BOOKINGS

The Customer selects the Services they wish to order on the website or indicates them on any document sent by the Service Provider, in accordance with the following arrangements:

Bookings can be made through our website http://www.barralet.fr or by emailing contact.barralet@gmail.com. The reservations department will send you a booking form to complete and return to us.

We are available to answer your questions from 1 January to 31 December on +33 4 66 22 84 52 or by email. Please feel free to call us to check availability.

Bookings are subject to availability. Management therefore reserves the right to refuse a booking.

To be valid, every booking must include a completed booking form and a deposit corresponding to 30% of the cost of the stay plus booking fees, or payment of the full cost of the stay.

When booking, you may request a specific pitch number. This will be allocated subject to availability. Management reserves the right to change your allocated pitch without prior notice.

Management cannot under any circumstances be held liable for the loss or theft of personal belongings.

Minors cannot make bookings. Furthermore, minors may only stay at the campsite if accompanied at all times by a parent or legal guardian.

The Customer is responsible for checking the accuracy of the Order and immediately notifying the Service Provider of any errors. The Order shall only be considered final once the Service Provider has sent the Customer confirmation of acceptance by email or post, or once the contract has been signed for bookings made directly at premises where the Service Provider markets the Services.

Any Order placed on www.barralet.fr forms a distance contract between the Customer and the Service Provider.

All Orders are made in a named person’s name and may not be transferred under any circumstances.

ARTICLE 3 – PRICES

The Services offered by the Service Provider are supplied at the prices in force on www.barralet.fr or in any of the Service Provider’s information materials when the Customer places the Order. Prices are expressed in euros, both excluding and including VAT.

Prices take into account any discounts offered by the Service Provider on www.barralet.fr  or in any information or promotional materials.

These prices are fixed and cannot be revised during their stated validity period, as indicated on www.barralet.fr, in the email or in the written offer sent to the Customer. Once this validity period has expired, the offer lapses and the Service Provider is no longer bound by the prices.

Prices do not include processing and administration fees, which are charged separately under the conditions indicated on www.barralet.fr or in the information sent to the Customer beforehand by post, email or other means. These fees are calculated before the Order is placed.

The payment requested from the Customer corresponds to the total purchase amount, including these fees.

An invoice is issued by the Seller and provided to the Customer no later than when the balance is paid.

3.1. TOURIST TAX

Tourist tax, collected on behalf of the municipality or intermunicipal authority, is not included in the prices. It is calculated per person per day and varies depending on the destination. It must be paid when paying for the Service and is shown separately on the invoice.

ARTICLE 4 – PAYMENT TERMS

4.1. BOOKING DEPOSIT

Advance payments constitute part payments towards the total price owed by the Customer.

A deposit corresponding to 30% of the total price of the Services ordered is required when the Customer places the Order. It must be paid upon receipt of the final rental contract and enclosed with the copy to be returned. It will be deducted from the total Order amount.

The Service Provider will not refund this deposit if the Customer cancels, except in the circumstances set out in Article 6.4 of these General Terms and Conditions.

The balance of the stay must be paid in full 30 days before the arrival date, failing which the rental may be cancelled.

4.2. PAYMENTS

Payments made by the Customer shall only be considered final once the Service Provider has actually received the amounts due in cleared funds.

Amounts due may be paid by bank transfer, remote payment, secure payment through our website, cash or French holiday vouchers (Chèques-Vacances). Bank cheques are not accepted by the campsite except for payment of the deposit or balance at least 30 days before the arrival date.

If the Customer fails to pay the amounts due within the period specified above or by the payment date shown on the invoice sent to them, late payment penalties calculated at a rate of 3.4% of the VAT-inclusive price of the Services shall automatically become payable to the Service Provider, without any formalities or prior formal notice.

Late payment shall make all amounts owed by the Customer immediately payable, without prejudice to any other action the Service Provider may be entitled to take against the Customer in this respect.

If the amounts due remain unpaid after a reminder from the campsite following late payment, and no written request has been made by the Customer, the Services ordered will be cancelled and any amounts already paid by the Customer will be retained by the campsite.

4.3. FAILURE TO COMPLY WITH PAYMENT TERMS

Furthermore, if the Customer fails to comply with the payment terms set out above, the Service Provider reserves the right to suspend or cancel the Services ordered by the Customer and/or suspend performance of its obligations after a formal notice has remained without effect.

ARTICLE 5 – PROVISION OF SERVICES

5.1. AVAILABILITY AND USE OF THE SERVICES

Accommodation is available from 3 pm on the arrival date and must be vacated by 10 am on the departure date.

Pitches are available from 2 pm on the arrival date and must be vacated by 12 noon on the departure date.

The balance of the stay must be paid in full:
  • 30 days before the arrival date, failing which the rental may be cancelled;
  • or on the arrival date, following a written request from the Customer and acceptance by the campsite.
Accommodation and pitches are rented for a specified number of occupants and must not, under any circumstances, be occupied by more people than this number.

Accommodation and pitches must be left in the same state of cleanliness as on arrival. Otherwise, the hirer must pay a flat cleaning fee of €50. Any damage to the accommodation or its equipment must be repaired immediately at the hirer’s expense. The inventory and condition of the accommodation at the end of the rental must be identical to those recorded at the start.

5.2. SECURITY DEPOSIT

For accommodation rentals, a security deposit of €200 is required from the Customer when the keys are handed over. It is returned on the last day of the rental, less any applicable repair or reinstatement costs.

This security deposit does not constitute a limit on liability.

ARTICLE 6 – LATE ARRIVAL, EARLY DEPARTURE OR CANCELLATION BY THE CUSTOMER

No reduction will be granted for late arrival, early departure or a change in the number of guests, whether for all or part of the planned stay, unless the Customer has taken out specific insurance with our partner Campez-Couvert and the circumstances are covered by the general insurance terms and conditions available at Campez-Couvert General Terms and Conditions.

6.1. CHANGES

If the Customer requests changes to the dates or number of guests, the Service Provider will endeavour to accommodate requests to change dates wherever possible, subject to availability and any additional charges. In all cases, this is an obligation to use reasonable efforts only: the Service Provider cannot guarantee the availability of a pitch, accommodation or alternative dates. An additional charge may apply.

Any request to shorten the stay will be treated by the Service Provider as a partial cancellation, the consequences of which are governed by Article 6.3.

6.2. EARLY DEPARTURE

Early departure shall not entitle the Customer to any refund from the Service Provider, unless the Customer has taken out specific insurance with our partner Campez-Couvert and the circumstances are covered by the general insurance terms and conditions available at Campez-Couvert General Terms and Conditions.

6.3. CANCELLATION

If the Customer cancels the Booking after it has been accepted by the Service Provider, for any reason other than force majeure, the deposit paid at the time of Booking, as defined in Article 4 – PAYMENT TERMS of these General Terms and Conditions of Sale, shall automatically be retained by the Service Provider as compensation and shall not be refundable, unless the Customer has taken out specific insurance with our partner Campez-Couvert and the circumstances are covered by the general insurance terms and conditions available at Campez-Couvert General Terms and Conditions.

In all cases of cancellation, processing and administration fees (Article 3) will be retained by the Service Provider.

6.4. CANCELLATION IN THE EVENT OF A PANDEMIC

6.4.1. If the establishment is closed fully or partially during the booked dates by order of the public authorities, for reasons not attributable to the Service Provider, advance payments made by the Customer for the stay will be refunded within 15 days. This also applies to a total or partial ban on admitting the public where the Customer is directly affected by the measure.

However, the Service Provider shall not be required to pay any additional compensation beyond the refund of amounts already paid for the Booking.

6.4.2. By way of exception to Article 6.3 CANCELLATION, any cancellation duly supported by evidence that the Customer has COVID-19 or another infection considered to form part of a pandemic, or has been identified as a close contact, and that this situation prevents their participation in the stay on the planned dates, shall be made without a cancellation penalty. An exception applies where the Customer has taken out specific insurance with our partner Campez-Couvert and the circumstances are covered by the COVID-19 extension in the general insurance terms and conditions available at Campez-Couvert General Terms and Conditions, or where a non-refundable credit voucher valid for 12 months is issued.

Any processing and administration fees provided for in these General Terms and Conditions will be retained by the Service Provider. In all cases, the Customer must provide evidence of the event entitling them to cancel.

6.4.3. By way of exception to Article 6.3 CANCELLATION, if the Customer is required to cancel the entire stay because government measures prevent participants from travelling (national or local lockdown, travel bans or border closures), even though the campsite is able to fulfil its obligations and welcome Customers, the Service Provider will refund advance payments within 15 days.

6.4.4 – If the Customer has taken out specific insurance covering the risks listed in Article 6.4.2 or Article 6.4.3, any insurance compensation received by the Customer will be deducted from the refund amount.

6.4.5. If the Customer cancels, or the Service Provider refuses access to the campsite, because the health pass presented is invalid, the Customer shall not be entitled to claim a refund.

ARTICLE 7 – CUSTOMER’S OBLIGATIONS

7.1. PERSONAL LIABILITY INSURANCE

Customers staying on a pitch or in accommodation must hold personal liability insurance. Proof of insurance may be requested before the start of the Service.

7.2. PETS

Pets are accepted under their owners’ responsibility and subject to the charges available from the Service Provider and payable on site.

7.3. CAMPSITE RULES

The campsite rules are displayed at the entrance and at reception. The Customer must read and comply with them. They are available on request.

ARTICLE 8 – SERVICE PROVIDER’S OBLIGATIONS – GUARANTEE

In accordance with statutory provisions and at no additional charge, the Service Provider guarantees the Customer against any lack of conformity or hidden defect arising from a fault in the design or delivery of the Services ordered.
To exercise their rights, the Customer must inform the Service Provider in writing of any defects or lack of conformity within a maximum of 1 day from the provision of the Services.

The Service Provider will refund, rectify or arrange for the rectification of Services deemed defective, where possible, as soon as possible and no later than 2 days after the Service Provider establishes the defect. Refunds will be made by crediting the Customer’s bank account or by sending the Customer a bank cheque.

The Service Provider’s guarantee is limited to refunding the Services actually paid for by the Customer. The Service Provider shall not be held liable or considered in breach of its obligations for any delay or failure to perform resulting from force majeure as generally recognised by French case law.

The Services supplied through the Service Provider’s website, www.barralet.fr, comply with the regulations in force in France.

ARTICLE 9 – RIGHT OF WITHDRAWAL

Activities relating to the organisation and sale of stays or excursions on a specific date or during a specified period are not subject to the withdrawal period applicable to distance and off-premises sales, in accordance with Article L221-28 of the French Consumer Code.
